The arbitrary legal cutoff (0.3% in the US, formerly 0.2% in the EU) distinguishing industrial hemp from marijuana, which has been criticized for its lack of scientific basis and for threatening legitimate hemp crops that test slightly above the limit.

The panel discussed a Colorado hemp farmer (Ryan Loughlin) whose crop tested at 0.5% THC and was ordered destroyed. Mark Scialdone questioned the sampling protocol, noting that tops test higher than bottoms and that moisture handling, extraction methods, and replicate consistency all affect results. Rob Clarke noted the EU uses batch testing from multiple plant parts rather than targeting the highest-resin flowers. Sam mentioned the Zolotomasha variety he used consistently tested at 0.01%.
